Legal Education 101 - Understanding the Westlaw Model Jury Instructions (Juries Exhibits)
Juries, instructions to the jury, or instructions regarding the evidence required for a case are legal rules which jurors must follow when determining a case in court. They are typically a necessary form of jury management procedure to ensure a just and fair trial. Frequently instructions are given by the judge or jury foreman in a legal trial to help the jury determine an issue or answer a question and to assist them in arriving at a legally binding jury verdict. They can also be given to attorneys before a trial as a preparation for possible future trials or as instructions to jury members before deliberations.
Some common instructions offered to jurors in legal English involve instructions on what they should know, how to act, and how to write. There are many types of instructions and/or questions that may be asked of the jurors during a trial. Frequently, questions about procedures and behavior are included in legal English instructions. While it is important for attorneys to provide instructions only when absolutely necessary, other than to remind juries of their legal responsibility, instructions in legal English are not generally required during trials. This is in contrast to instructions in English commonly given in civil cases, such as negligence or slander actions, where legal English instructions are almost always required.
There are several types of instructions and questions that juries are expected to answer during deliberations, including questions about jurisdiction, law, evidence, and adhering to the instructions of the court. The judge or jury foreman usually provides this instruction at the beginning of the trial or hearing. In some instances, the instructions given to juries may overlap; in this case, the lawyers for both sides will request a jury foreman to clarify any questions that are confusing to the jurors. These juries foremen are typically experienced in legal practices and can provide further assistance to the attorneys.
One type of legal instruction or question that is frequently asked by attorneys is regarding jury nullification instructions. This question is part of the basic right of the jury to decide the case's outcome. In order to avoid a potentially unjustified decision, attorneys for each side must provide adequate instructions to their jurors concerning jury nullification instructions and how they should apply them to the facts of the case.
Model jury instructions are also often asked questions. Model instructions are created based on the instructions found in the law. Model legal instructions may include any number of different components, including instruction on what is not allowed during deliberations, what constitutes "malpractice" or misconduct, what constitutes harmless testimony, and more. Each model instruction may vary slightly from state to state but all may include one or more of the fundamental components found in legal English.
Some legal professionals like to study old English law to gain a better understanding of the common legal questions asked at trials. This may include searching through old court documents, examining dictionaries, and browsing through legal books. Other professionals like to use the Internet to find more information about legal questions and their answers. Legal podcasts and websites may contain updated information regarding the trial.
